Rule of Law Anchors Hong Kong on Its Journey Ahead

Rule of Law Anchors Hong Kong’s Journey Forward

Hong Kong is charting a new course, anchored firmly in the rule of law and its unique position under the “One Country, Two Systems” framework. For over two decades since its return to the motherland in 1997, the Hong Kong Special Administrative Region (HKSAR) has upheld its common law traditions, fostering stability and growth.

One of Hong Kong’s greatest strengths is its common law system, which sets it apart as the only jurisdiction in China practicing common law. This legal framework not only supports the city’s robust financial and trading sectors but also enhances its reputation as an international hub for legal and dispute resolution services.

The enforcement of the Hong Kong national security law in 2020 has further solidified the city’s legal foundation. Respecting common law traditions, this law strengthens mechanisms to safeguard national sovereignty and security, ensuring a secure environment for residents and businesses alike.

Hong Kong’s Department of Justice is actively enhancing the city’s legal landscape by introducing measures to attract global legal talent and updating laws to keep pace with international trends. Initiatives like streamlined entry for international arbitration participants and new regulations for emerging technologies demonstrate Hong Kong’s commitment to maintaining a dynamic legal system.

Moreover, Hong Kong plays a pivotal role in the country’s broader development strategy. The recent establishment of the International Organization for Mediation’s headquarters in Hong Kong highlights the city’s international credibility and legal prowess.

As an integral part of the Guangdong-Hong Kong-Macao Greater Bay Area (GBA), Hong Kong collaborates closely with neighboring regions to promote legal cooperation and talent mobility. Policies allowing businesses to adopt Hong Kong law and choose Hong Kong as the seat of arbitration in selected Chinese mainland cities within the GBA strengthen cross-regional ties.

Looking ahead, Hong Kong remains committed to leveraging its common law system to support the full and precise implementation of “One Country, Two Systems.” By reinforcing legal certainty and security, Hong Kong is poised to continue its journey as a global leader in legal services and a bridge between the Chinese mainland and the international community.
