China Tightens Dual-Use Export Controls to the U.S.

China’s Ministry of Commerce (MOC) announced on Tuesday that it is tightening control over the export of dual-use items to the United States to safeguard national security and fulfill international obligations.

According to the MOC, the export of dual-use items to U.S. military users or for military purposes is now prohibited. Items related to gallium, germanium, antimony, and superhard materials will, in principle, not be permitted for export to the U.S. Additionally, stricter examinations will be conducted on end-users and end-use purposes for the export of graphite-related dual-use items.

This decision takes effect immediately. Any organization or individual violating these provisions by transferring or providing relevant dual-use items originating from China to the United States will be held legally responsible, the ministry stated.

Dual-use items refer to goods, technologies, and services that can be used for both civilian and military purposes or that contribute to military capabilities, including the development or use of weapons of mass destruction.

An MOC spokesperson explained that the decision aligns with Chinese laws, including the Export Control Law of the People’s Republic of China. The spokesperson noted that in recent years, the United States has expanded the concept of national security, politicized and weaponized economic and technological issues, and abused export control measures by restricting relevant products to China and placing multiple Chinese companies on sanctions lists.

The spokesperson added that these U.S. actions undermine international trade rules, affect the legitimate rights and interests of enterprises, and disrupt the stability of global industrial and supply chains. The Chinese government remains committed to promoting high-standard opening up and opposes the overgeneralization of national security concerns.

“China is ready to strengthen dialogue on export control with relevant countries and regions to jointly promote the security and stability of global industrial and supply chains,” the spokesperson said.
